Der Mieter hat das Objekt bei \u00dcbernahme auf Sch\u00e4den\/Verschmutzungen zu pr\u00fcfen. Unterl\u00e4sst er die Anzeige von sichtbaren M\u00e4ngeln, gilt das Mietobjekt als schadensfrei \u00fcbernommen. Erfolgt keine Angabe, gilt die in der Signatur oder dem Briefkopf des Vertragspartners angef\u00fchrte Adresse als Rechnungsadresse. F\u00fcr eine nachtr\u00e4gliche \u00c4nderung oder Neuausstellung der Rechnung aufgrund falsch \u00fcbermittelter oder fehlender Daten wird eine Bearbeitungsgeb\u00fchr von EUR 100,\u2013 netto (zzgl. 20 % USt) verrechnet.<br \/>\n<strong>(2) Fehlinformationen und unrichtige Angaben:<\/strong><br \/>\nF\u00fcr unrichtige oder unvollst\u00e4ndige Angaben zu Lieferadressen, Veranstaltungsorten, Ansprechpartnern vor Ort oder sonstigen vertragsrelevanten Rahmenbedingungen wird f\u00fcr den entstandenen Mehraufwand eine Pauschale von EUR 50,\u2013 netto (zzgl. 20 % USt) verrechnet. Sollte der Vertragspartner vors\u00e4tzlich falsche Angaben machen, wider besseres Wissen Tatsachen leugnen oder den Veranstalter bewusst t\u00e4uschen, wird je nach Schweregrad und administrativem Ermittlungsaufwand eine P\u00f6nale von EUR 50,\u2013 bis EUR 200,\u2013 netto (zzgl. 20 % USt) f\u00e4llig. Die Geltendmachung eines dar\u00fcber hinausgehenden Schadens bleibt vorbehalten.<br \/>\n<strong>(3) Zahlungsbedingungen und Verzugszinsen:<\/strong><br \/>\nRechnungen sind innerhalb von 14 Tagen ab Erhalt ohne Abzug zur Zahlung f\u00e4llig. Nach Ablauf dieser Frist ger\u00e4t der Vertragspartner automatisch in Verzug. Bei Zahlungsverzug wird eine erste Mahnung mit einer Nachfrist gesetzt. Wird auch diese Frist nicht eingehalten, werden f\u00fcr die Erstellung der Mahngeb\u00fchrenrechnung sowie den administrativen Mehraufwand pauschal EUR 100,\u2013 netto (zzgl. 20 % USt) verrechnet. Unbeschadet dessen gelten f\u00fcr Unternehmer die gesetzlichen Verzugszinsen gem\u00e4\u00df \u00a7 456 UGB (9,2 % \u00fcber dem Basiszinssatz).<br \/>\n<strong>(4) Versp\u00e4tete Abholung, Retournierung und Logistikausf\u00e4lle:<\/strong><br \/>\nBei vereinbarter Selbstabholung oder selbstst\u00e4ndiger Retournierung sind die vereinbarten Zeiten strikt einzuhalten. Eine versp\u00e4tete \u00dcbergabe st\u00f6rt den Betriebsablauf und die Tourenplanung des Logistik-Teams erheblich. Der Vertragspartner haftet f\u00fcr alle daraus resultierenden Mehrkosten und Sch\u00e4den. M\u00fcssen Logistikrouten aufgrund der Versp\u00e4tung umgestellt werden und entstehen dadurch Lieferverz\u00f6gerungen, Preisnachl\u00e4sse oder Regressforderungen bei Drittkunden, tr\u00e4gt der Vertragspartner diesen wirtschaftlichen Schaden in voller H\u00f6he. Der Veranstalter ist berechtigt, diese Schadensumme direkt von einer hinterlegten Kaution einzubehalten.
